Yeah Toho is and always has been overly defensive of copyrights, much like Disney. In fact in a funny reversal of fortune in 1993 Disney threatened to sue Toho because Rodan flew over Disneyland Tokyo without permission! Imagine the headlines if that went through-Mickey Mouse vs Godzilla! That was also the year Raymond Burr passed away so unfortunately Godzilla would not have been able to get hid old pal Perry Mason to represent him in court!

Wait, wouldn't it have been either a model or backdrop of Tokyo Disneyworld? I mean, Rodan doesn't exist in real life. It's a puppet or a guy in a suit. So, if they had the puppet fly over a model or a picture, how...?

Yup it was a filmed backdrop that Rodan flew over-Disney did not give permission for the park to be seen in the movie and was ticked about it. Usually Toho asks permission from businesses whose buildings they plan to destroy, and most places are more than happy-it is considered something of an honor to have your building smashed by Godzilla!
