Universal Studios comes down on Electric frankenstein book

I find it strange that Universal hasn`t gone after the band called Electric Frankenstein.

They couldn't do anything about a band or anyone else using the name Frankenstein or Dracula or Hunchback or Phantom; they would have to be using an image close to Universal's copyrighted monsters or something like using the same font that Universal has used for their monsters!

They've gotten several C&D letters over the years from Universal regarding their posters and album covers, though. But, I do believe they've put out two more art books since the original. The third one might still be just in the works.

What one must also remember, and here I must tread lightly, is that a C&D letter does NOT actually mean you have done something illegal, it means that someone (a lawyer usually) SAYS you did.

Usually, they are a scare tactic, they are actually partially explained as "The cease and desist letter may threaten further legal action even if the intellectual property holder has no intention of pursuing it. A cease and desist letter might be all that is necessary for both parties to reach an agreement over a dispute. Lawsuits can be stressful, time consuming, and expensive; a cease and desist letter could avoid many problems that come with litigation."

So until someone stands up and says "Go ahead, sue me!" and takes the case to court they win not because they were right, but because the other team forfeited.
