I would open the case on Paypal too. Once money is pulled and accounts go negative, you'll be amazed on how fast a resolution will be resolved. Once opened, they will have sufficient time to either honor your winning bid and supply a tracking or you will get your refund. Just giving my two cents based on experience.

You will not be permitted to sell anything in The UMA via any of the forums or via the Private Messaging System.  Any Violations of this will result in permanent expulsion from The  UMA   NO EXCEPTIONS.

it seems that this is the only post by this erasmusholmes, so it seems like they pretty much ignored the rules. i have taken up complaint with ebay and have yet to receive any response it seems that  eramusholmes ignored the rules about the number of postings required before posting a selling ad.
 this member has consistently ignored multiple emails from me, shipped the item late, actually a day before last day of the delivery estimate and i attempted to be patient but i can't believe this refusal to answer the complaint i filed with ebay and i have yet to receive my purchase. i just hope this can be resolved.

It's been discussed before, and it's being discussed again.  The problem with requiring a post count is that it doesn't take a great deal of effort to make 25 or so posts.  Hit all the various game threads and make a couple of comments and you're there.  And then it leaves some false sense of security, that this person has posted, so suddenly they are going to take an interest and be honest. 

My experience has been that there are a couple of main types of scammer.  One is the person who has reasonable intentions and poor follow-through.  This might be because they have a drug or alcohol problem, a mental issue (depression, etc.), or they are just flaky people.  Those are a few of the things that might cause someone who has reasonable intentions to have poor or no follow through.  Another type is the outright thief.  The seller in this thread appears to be the first type.  An outright thief would not list stuff on eBay and promote it here, they would just list it here. 

Of course, the result is the same, but I was ripped off, along with many others, by a guy on another board that was a longtime member, frequent participant, and moderator.  He was selling his collection, and it was all stuff he had, but started running short of money to ship, and eventually just ran off.  He was that #1 type. 

We could make a rule that a member who hasn't posted 25 or 50 times cannot post items for sale, and it would be fairly easy from a software standpoint to disallow posting in this forum by anyone who hasn't met a certain posting level.  Then, however, people who have not achieved the posting level we set, could not respond to threads about items for sale, either.  And, they couldn't post that they are selling items on eBay, that might be of interest.  Of course, that is where this seller falls, but eBay does offer a safety net for buyers that we can't offer, and a transaction on eBay is much safer for the buyer than a transaction on the UMA.  Those who have had other experiences in the past should note that eBay's buyer protection is MUCH more robust than it used to be, especially when the payment is made through PayPal.  Payments sent through PayPal for non-eBay transactions are not afforded the same level of buyer protection.

The fact is that requiring a posting limit in order to post in Classifieds would not significantly impede anyone from being a thief, and it would impede some legitimate activity.  I've registered at forums that had posting limits to sell, and I've been selling in about 30 minutes.  There was certainly no larceny involved.  I've seen forums that didn't prevent anyone from posting or starting threads in Classifieds, and relied on the community to report anyone who posted items for sale without reaching the limit.  It still doesn't stop anyone from making a few posts and then start selling.  We have numerous lurkers and seldom posters on this forum who are active readers and buyers.  Many people are not comfortable posting on a forum.

And before eBay, before the internet was used for person to person trading on a level of any significance, most of the toys and collectibles we would be interested in were advertised in and sold through Toy Shop magazine.  For those who are not familiar with it, it was a newsprint publication that was the size of most community free papers, that had listings of toys and collectibles for sale, and a few articles.  I advertised in it frequently, and my salesperson told me that they received complaints from buyers who were scammed by advertisers with some regularity.  In this instance, people were paying for an ad, and then ripping people off through it.  Of course, they would decline to run anymore ads from that individual, but there was no vehicle through which we could all communicate the bad sellers to each other, as the internet didn't play a role in it. 

One seller who ripped people off on this board, and who had a very low post count, also ripped people off on another forum, for a different type of item, and on a forum where he had been a participant for some time. 

It would feel like SOMETHING was being done, but in reality it doesn't stop anyone.  It doesn't even really slow them down.  And it does harm legitimate commerce.

What if, as has happened before here, someone who was not a monster collector or fan, had some monster items (from yard sale, relative, etc.) they were researching and found the UMA, asked questions about them, and then listed them for sale on eBay and mentioned that here, so that those who had helped them could have an opportunity to buy the item(s), or follow along the bidding?  Do we want to inhibit that person from posting here?  If they don't have the post count, they are more likely to just blow it off than to run around posting, while someone bent on thievery is going to make the posts in order to commit their crime.  Now we are both inhibiting legitimate posts, and not doing much to stop illegitimate ones, and meanwhile creating a false sense of security for members.

We would be interested to hear your thoughts.

I'm always leery when new members post items for sale.  I feel kind of used as a member of this group.  I always use a Credit Card through Paypal.  I can at least dispute it through the Credit Card if paypal does not take care of it.  As for current members such as yourself, Creepy Jeff or others, I would not hesitate to buy anything from them.  It's unfortunate, but I always proceed with caution when ordering anything on line from sites or sellers I do not know or that have low feedback.

i finally receive a message once i opened a case with ebay, the seller stated they had a death in the family and is offering a refund or my item, i chose to receive my purchase. i am now awaiting the sellers response and i will close the case once the purchase is received. i consider my lesson learned and will be more vigilant in my purchases. It is sad to hear of a death in the family and it is understandable, but i am also a little leery due to the fact that she posted that my purchase was shipped on December 28th, but now the seller says they were unable to ship due to a family crisis, i find that a little strange but I would hate to think that someone  would lie about death. i  have to take this at face value and want to finish this  case with civility so i left a sympathetic email requesting the purchase, but i am not sure what kind of feedback i should leave, maybe neutral? :-\
i think it might be like toy ranch said a case of good intentions and poor follow through although i must admit i feel guilty doubting the sellers reasoning but i just wonder why they marked the purchase as shipped?

i can totally see toy ranch's point, maybe the only real solution is if a buyer has an issue maybe they can post a reply stating the issue with the seller, so other members can see the problem and then judge for themselves whether or not to shop with the seller?

so i finally got my item, once i filed a case two days later i actually got a response stating that my purchase was in the mail, i got it on Saturday.
i closed the case and feel that it came to a civil and satisfactory conclusion but i am not sure the feedback i  should leave.
a part of me wants to be forgiving but i am just not sure what direction to go in.
 i might leave neutral feedback but would love any of your suggestions :-\

The feedback should reflect the poor comunication and delayed shipping.  Even if you don't want to blacklist someone for circumstances beyond their control, you'll only be hurting other buyers if they see this person as having no faults.

 Been following this thread, and very happy you recieved the item and a happy ending.  Since I usually check the feedback of someone I have never delt with before to see others comments, I like to think what I'm reading really reflects the way the seller conducts his business.  I think you should leave a comment on the lack of communication / shipping issues at least.  As a warning to others.

I don't want to seem insensitive if there really was a death in the family, but I have conducted eBay business amid dealing with family emergencies - children in the hospital, death in the family, etc. - and I still made shipments in a timely manner.  It can be done.

To go along with what Andy said, even if some major event was preventing the shipping of the item, you'd think an email could easily be squeezed in within a couple of days or so.  As to the feedback, you got your item (presumably in the expected condition), but it was an ordeal to get it sent.  Maybe go with neutral, but make a comment to let other buyers know how long you had to wait.

thanks for all of the advice i left neutral feedback stating i had to start a case to get my purchase but eventually reached satisfactory and civil conclusion i  also left only one star for the shipping and time so i hope this will help future shoppers in being aware of this sellers issues.
i thought that in the end neutral is fair although my boyfriend thought i was being a softy ::)

You did the right thing w leaving a neutral IMHO, and the star rating will mean more to them as a seller in the long run, as it determines ebay seller ranking. Glad you got your Wolf Man in the end. Now, are you going to look for the other colors? ;)
